Acceptance of Terms

By accessing or using BetaBox ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using BetaBox, you represent that: • You are at least 18 years old or have reached the age of majority in your jurisdiction • You have the legal capacity to enter into a binding agreement • You are a Google Play developer with a valid individual developer account • You are not prohibited from using the Service under applicable laws • You will comply with all applicable laws, regulations, and Google Play policies

Description of Service

BetaBox is a Google Play Closed Testing compliance service designed specifically for individual Android developers. Our service helps you meet Google Play's mandatory testing requirements.

Core Services: • Provide access to 12+ real physical Android devices with unique Google Play accounts • Facilitate the mandatory 14-day consecutive testing period required by Google Play • Ensure compliance with Google Play's closed testing requirements for individual developers • Track and verify testing progress through our centralized management system

How It Works: • You add your app to Google Play's closed testing track • You invite our managed device accounts as testers • Our devices download and run your app for the required 14-day period • We track compliance and provide progress reports

User Accounts

Account Creation: To use BetaBox, you must create an account. You agree to: • Provide accurate, current, and complete information • Provide valid Google Play developer account details • Maintain the security of your password and account • Promptly update any information to keep it accurate • Accept responsibility for all activities under your account

Developer Requirements: • You must have an active Google Play individual developer account • Your app must be properly uploaded to a closed testing track • You must have the rights to submit the application for testing • Your app must comply with Google Play's policies and guidelines

Account Security: You are responsible for safeguarding your account credentials. You must immediately notify us of any unauthorized access or security breach. BetaBox will not be liable for any loss or damage arising from your failure to maintain account security.

Account Termination: You may delete your account at any time through your account settings. We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

Acceptable Use Policy

You agree to use BetaBox only for lawful purposes and in accordance with these Terms. You may NOT:

Prohibited Content: • Submit apps containing malware, viruses, or malicious code • Submit apps that violate Google Play's Developer Program Policies • Submit apps that infringe intellectual property rights • Submit illegal, harmful, or offensive content

Prohibited Actions: • Attempt to gain unauthorized access to our systems or devices • Use our service for any purpose other than Google Play closed testing compliance • Submit apps to multiple testing services simultaneously with the same testers • Misrepresent your identity or developer account status • Attempt to manipulate testing results or status reports • Share tester account credentials with third parties

App Requirements: • Apps must comply with all Google Play policies • Apps must be in a testable state (can be installed and launched) • You must have legal rights to submit the application • Apps must not interfere with device operation or other apps

Testing Process and Requirements

Testing Setup: Upon payment, you will receive: • Email addresses for 12+ unique Google Play accounts • Instructions to add these accounts to your closed testing track • Access to our dashboard for tracking progress

Your Responsibilities: • Add our tester accounts to your closed testing track within 24 hours of purchase • Ensure your app is published and available on the testing track • Maintain app availability throughout the 14-day testing period • Respond promptly to any technical issues we report

Our Responsibilities: • Download and install your app on our managed devices • Maintain active testing for 14 consecutive days • Provide progress tracking through our dashboard • Notify you of any issues affecting testing compliance

Testing Period: • Testing begins within 24 hours of setup completion • The 14-day period must be consecutive without interruption • If testing is interrupted due to issues on your end (app unavailable, track closed, etc.), the counter may reset • We track testing status daily and update your dashboard

Completion: • You will be notified when the 14-day period is complete • We recommend waiting 24-48 hours after completion before applying for production access • We provide documentation of testing completion upon request

"AS IS" and "AS AVAILABLE": THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Guarantees: BetaBox does not guarantee that: • Google will approve your app for production release after testing • The testing service will meet all future Google Play policy changes • Our service will be uninterrupted, timely, secure, or error-free • Any particular outcome from Google Play review process

Google Play Policy Compliance: • We help you meet the technical testing requirements only • Approval for production release depends on many factors beyond testing • Google may change their policies at any time without notice • We are not affiliated with Google and cannot guarantee their decisions

Third-Party Services: Our Service interacts with Google Play services. We have no control over and assume no responsibility for Google Play policies, decisions, or service availability.

Device and Account Management: • Devices may occasionally experience technical issues • We maintain backup devices to ensure service continuity • Account availability is subject to Google's terms of service

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETABOX AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES SHALL NOT BE LIABLE FOR:

Indirect Damages: • Lost profits, revenue, or anticipated savings • Loss of business opportunities • Incidental, special, or consequential damages • Damages arising from Google Play decisions or policy changes • Any indirect damages arising from use of the Service

Direct Damages: Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us for the specific service giving rise to the claim.

Specific Exclusions: We are not liable for: • Google Play rejecting your app for any reason • Changes to Google Play policies affecting your app • Delays caused by issues with your app or developer account • Any decisions made by Google regarding your developer account

Exceptions: Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability will be limited to the fullest extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless BetaBox and its licensors, service providers, employees, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the Service • Your violation of these Terms • Your violation of Google Play policies or terms of service • Your app content or functionality • Your violation of any third-party rights • Any claims arising from your app's users or distribution • Misrepresentation of your developer status or rights

We reserve the right to assume the exclusive defense of any matter subject to indemnification by you. You agree to cooperate with our defense of such claims.

Termination

Termination by You: You may cancel your testing service at any time. Refund eligibility depends on the testing status and is subject to our refund policy.

Termination by Us: We may terminate or suspend your service immediately, without prior notice, for any reason, including: • Violation of these Terms • Submission of apps containing malware or prohibited content • Violation of Google Play policies • Fraudulent, abusive, or illegal activity • At our sole discretion

Effect of Termination: Upon termination: • Testing will cease immediately • You will lose access to our tester accounts • No refunds for completed or in-progress testing periods • Any licenses granted to you will terminate

Service Completion: After successful completion of the 14-day testing period: • Our tester accounts will remain on your testing track unless removed by you • You may remove our accounts from your testing track at any time • Your dashboard access will remain active for 30 days after completion

Governing Law and Disputes

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Dispute Resolution: Any dispute arising from these Terms or the Service shall be resolved through:

1. Informal Resolution: First, try to resolve the dispute informally by contacting us at support@betabox.tech.

2. Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules.

3. Small Claims: You may bring claims in small claims court if your claims qualify.

Class Action Waiver: You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Venue: For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of courts located in San Francisco, California.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes:

• We will post the updated Terms on our website • We will update the "Last Updated" date • We may notify you via email or in-app notification

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

Google Play Policy Changes: If Google Play changes their testing requirements, we will: • Update our service to comply with new requirements • Notify affected users of any changes • Adjust testing procedures as necessary
